What is a UK Spouse visa?

You can apply for a UK Spouse/Partner visa if you are the spouse or partner of a British citizen or a person with settled status (ILR holder) and wish to join them in the UK permanently.

This visa paves the way to settlement, allowing you to apply for indefinite leave to remain (ILR) after living in the UK as the spouse of a British citizen or settled person. To apply, you must meet the requirements outlined in Appendix FM of the Immigration Rules.

As specialists in UK spouse visa applications, we offer comprehensive immigration advice tailored to your specific circumstances. We can handle the preparation and submission of your application to the Home Office, acting as your dedicated immigration solicitors.

What are the requirements for a UK Spouse visa?

To qualify for a UK spouse/marriage visa, you must meet the following requirements:

  • Both you and your spouse must be 18 years old or older.
  • You must have met each other in person and be legally married to prevent arranged marriages.
  • You must intend to live together permanently.
  • You must have sufficient funds to support yourselves (and any dependents) without relying on public funds.
  • Your sponsoring partner must earn at least £18,600 per year or have adequate savings to sponsor you.
  • If dependent children are also being sponsored, the minimum financial requirement is higher.
  • You must have suitable accommodation for yourself, your spouse, and any dependents.
  • You must meet the English language requirements.

What are the financial requirements for a UK Spouse visa?

To prove that you can be adequately maintained in the UK without relying on public funds, you must meet the financial requirement as outlined in Appendix FM.

For a UK Spouse visa application, you need to demonstrate that your spouse (or both of you jointly, if you are already in the UK with valid leave to remain) has a gross annual income of at least:

  • £18,600; plus
  • £3,800 for the first child (who is not British, settled, or an EEA national); plus
  • £2,400 for each additional child (who is not British, settled, or an EEA national).

There are special circumstances under which you may be exempt from these financial requirements. Contact our leading immigration lawyers to determine if you need to meet the financial requirement for a spouse visa.

Challenge spouse visa refusal

Numerous factors can lead to the refusal or rejection of a spouse visa application. The UK Home Office, specifically UK Visas and Immigration (UKVI), rigorously examines such applications to prevent fraudulent activities like ‘sham’ marriages or ‘marriages of convenience’. While a denied application typically doesn’t entail a refund, there’s often the option to appeal the decision and potentially reverse the initial outcome. Whether you initiated the application independently or with the help of a third-party immigration consultant, we stand ready to support you through the appeals process.
